Sponsered Parent Visa (Subclass 870) – Temporary

Overview

This temporary visa, known as the Parent Visa, offers the opportunity for a parent of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to travel to and stay in Australia for an extended period of either 3 or 5 years. This visa category facilitates family reunification and allows parents to spend quality time with their loved ones residing in Australia, fostering stronger familial bonds and creating lasting memories.

Individuals holding this temporary visa can enjoy the privilege of visiting Australia for a duration of up to 3 or 5 years per visa, depending on their circumstances. Moreover, they retain the option to apply for further visas, extending their stay to a maximum cumulative period of 10 years in Australia. However, it’s important to note that while on this visa, they are not permitted to engage in any form of employment within the country. This restriction ensures compliance with immigration regulations and maintains the integrity of the visa program, emphasizing its primary purpose as a means for familial visits and reunions rather than employment opportunities. Before applying for this visa, it’s advisable to arrange a consultation with a migration consultant to thoroughly discuss the terms and conditions of the Australian Migration Visa.

Sponsored Parent Visa (temporary) Requirements:

The Subclass 870 Visa application should be error-free and include all the necessary documents for the visa. To help keep track of these requirements, using a checklist is highly recommended. The essential 870 Visa Requirements are outlined below:

  1. The applicant must have an approved Parent Sponsor before you can lodge an application for this visa
  2. Utilize the online application platform for visa submission.
  3. Submit your visa application within six months of sponsorship approval, or within 60 days if granted Permission to Apply in Australia.
  4. Both character and health requirements must be met.
  5. Any outstanding debts should be cleared.

Subclass 870 Visa Eligibility Criteria:

Before being granted the visa, there are several criteria that need to be met. It’s essential to carefully adhere to each of these points, as failure to do so may result in the rejection of your application. Australian government officials, who are highly trained, will assess your visa application for approval.

  1. The applicant must be the biological, legal (including adoptive) parent, step-parent or parent in-law of the Parent Sponsor.
  2. Sponsorship: The applicant must have a sponsor, preferably an eligible child. If the child is unable to sponsor, an eligible relative or another eligible person can provide sponsorship.

  3. Age Requirement: The applicant must be at least 18 years of age.

  4. Stay Condition:

    You must intend to:

    • stay only temporarily in Australia
    • do only the things the visa allows you to do.
    • If you have already submitted an application for a permanent parent visa, you are allowed to visit Australia, but you must not stay permanently while the application is under review. This visa is strictly temporary, and you will not be eligible for permanent residency. Additionally, if you have applied for or are already holding this visa, you are ineligible to apply for either a permanent or temporary parent visa.
  5. Health Condition: The applicant and their family members must meet the health requirements set by the Australian Department of Health.

  6. Character Requirement: Both the applicant and their family members must meet the character requirements as specified by the Australian Government.

  7. Health Insurance: You are required to possess and sustain sufficient health insurance coverage from an Australian health insurance provider to address any unforeseen medical needs that may arise during your stay in Australia.

  8. Debts: You or any member of your family should not have any outstanding debts. If such debts exist, you need to repay them to the Australian government.

  9. Previous Visas: You must have met and complied with any previous visa obligations.

  10. Health Insurance: You are required to possess and sustain sufficient health insurance coverage from an Australian health insurance provider to address any unforeseen medical needs that may arise during your stay in Australia.

There is no balance of family test or Assurance of Support requirements for this visa.

This Subclass 870 visa category serves as a means for parents to reunite with their children in Australia, granting them the opportunity to visit for periods of up to 3 or 5 years per visa, depending on individual circumstances. Moreover, parents can reapply for further Sponsored Parent (Temporary) visas, extending their total stay in Australia to a maximum of 10 years. It’s important to note, however, that individuals holding this visa are not permitted to engage in any form of employment within Australia during their stay.

This visa is temporary and does not lead to permanent residency. While holding this visa, you are ineligible to apply for either permanent or temporary parent visas. You can apply for stays in Australia for periods of up to 3 or 5 years, as specified in the visa grant letter, with the duration determined on a case-by-case basis, taking into account factors such as your desired length of stay and the sponsorship cessation date. However, the requested length of stay may not always be granted. Additionally, if you have been granted a Sponsored Parent (Temporary) visa, the sponsor’s other parent cannot receive a visa with a later end date. For instance, if Parent A is sponsored by Child A for a 3-year visa and Parent B applies for a visa 18 months later, Parent B can only receive a visa for the remaining period of Parent A’s visa validity (e.g., 12 months). The visa will end on the specified date in the grant letter, if cancelled by immigration authorities, or if sponsorship is withdrawn without finding a new parent sponsor.

Stay Longer:

You are permitted to stay in Australia for a total of up to 10 years, which includes the cumulative duration of all Sponsored Parent (Temporary) visas held. However, extending this visa for a longer stay is not an option. To prolong your stay in Australia, you must apply for and receive a different type of visa. Additionally, if seeking another Sponsored Parent (Temporary) visa, you must spend at least 90 days outside of Australia before being eligible for another grant, unless you have obtained Permission to Apply in Australia. Once you have reached the maximum cumulative 10-year period on Sponsored Parent (Temporary) visas, you must either leave Australia or secure a different visa type to remain in the country. Further applications for Sponsored Parent (Temporary) visas will not be considered beyond this point.

  • Your application processing time may be prolonged if there are errors in its completion or if essential documents are missing. Additionally, if further information is required from you, it can extend the processing period.
  • Verification of the information provided in your application may also contribute to delays in processing.
